The Firm's Personnel:

Rachelle Freed was admitted as an Attorney in 1999 with the qualifications BLC. LLB. With her interest in property law, she was successfully admitted as a conveyancer in 2002. She is involved in all property related matters and has extensive experience with transfers.

Charleen Anderson was admitted as an Attorney in 2002 with the qualification B. Jur. LLB. She assists mainly with legal matters related to conveyancing, such as the preparation of lease and sale agreements, eviction notices, drafting of documents (transfer / bonds) and so forth.

Both partners have been involved in conveyancing in excess of five years and have attended several conveyancing courses to keep updated with the latest developments.

A conveyancing paralegal provides the firm with her expertise on a contractual basis. She has been involved in property related matter in excess of twenty years and specialises in sectional title developments.

The Firm's Services:

- Fast and efficient drafting services are rendered once we have received all required documents from clients. The Ghostconvey system is utilized in the drafting of Bond and Transfer documentation.
- Signings are then scheduled at the convenience of the client, which means that most signings are arranged after hours at the client's residential address.
- Certain professional individuals are employed on a contractual basis at the firm's expense to obtain Rates and Clearance certificates.
- We have various recruited correspondents throughout South Africa enabling us to lodge documents where needed.

We form lasting relationships with our clients and do what we can to ensure satisfaction in all aspects of our services. This is attained and maintained by, providing advice, explaining procedures and costs of all transactions, keeping clients updated about such transactions, and providing a follow-up service.


The Firm's Areas of Specialisation:

- Registration of all Mortgage and Notarial bonds, registration of Servitudes and other Real Rights against properties, transfers of Freehold and Leasehold properties and transfers from the Sheriff.
- Preparing agreements relating to property ownership including Lease and Sale Agreements.
- Opening of Sectional Title Registers.
- Sub-divisions and Consolidation of land.
- Acquisition by property owning Companies and Close Corporations.
- Applying for all Residential and Agricultural Holding Home Loans on behalf of clients.

Procedures and Costs Involved in the Transfer of Property:

- Costs involved for the seller:

- Estate Agent's commission is deducted from proceeds (if applicable).
- Cancellation Attorney fee.
- Electrical Compliance Certificate fee.
- Rates & Taxes – six months payable in advance. A pro rata refund from date of registration must be given to the seller by the Municipality.

- Costs involved for the purchaser:

- Transfer Attorney's fee (this is for transferring the property from the Seller to the Buyer).
- Bond Attorney's fee (this is for the registration of the Bond in favour of the banking institution).
- Transfer Duty (to be paid before lodgement at the Deeds Office).

- Procedure:

- Transfer Attorney receives instruction and signed contract
- Once the contract is signed, the Mortgagor must apply for a Mortgage Bond or pay the balance of the purchase price in cash.
- The contract usually requires the Purchaser to deliver a guarantee to secure payment of the purchase price on registration.
- The Seller and Purchaser are contacted and certain documents and information are requested
- Cancellation figures are requested to cancel the bond of the Seller. The normal turn-around time of the banking institution is five days, but it can take longer. The same banking institution will then forward the original Title Deed and Mortgage Bond(s) to the Cancellation Attorneys.
- Rates and Taxes Clearance figures are requested from the Municipality. This usually takes five to ten working days.
- If a deposit needs to be paid, it will be called for by the Transfer Attorney. The Purchaser must always ask for a receipt as proof of payment.
- Once the Mortgage Bond has been grated and the aforementioned is in place, the Transferring Attorneys will schedule for the documentation to be signed and costs called for.
- Once payment has been received, Transfer Duty will be paid to the Receiver of Revenue (takes approx. 1 -3 working days to obtain the required Transfer Duty receipt);
- A local Municipality is paid to obtain Clearance Certificate (3 – 5 working days). These costs are paid by the seller.
- Both the above documents are lodged at the Deeds Office.

- The Bond Attorneys will schedule a signing for the documentation only after receipt of the Draft Deed and guarantee requirements from the Transfer Attorneys. The Transfer Attorneys on the other hand, can only forward their guarantee requirements and Draft Deed once they have received the Cancellation Figures and a copy of the Title Deed from the Cancellation Attorney.
- The Transfer Attorneys arrange for simultaneous lodgement with the other attorneys.
- The Deeds Office takes approximately seven to fourteen working days to check all the documentation, where after the Transfer and Bond will register.
